Tracy Morgan is out of hospital

But still faces treatment for his crash injuries

30 Rock star Tracy Morgan has been released from hospital, five weeks after being seriously injured in a car crash.

The comic will undergo an 'aggressive outpatient programme' to treat his injuries, which include broken legs, nose and ribs.

It has also been revealed that his lawyers have launched action against Walmart, who owned the truck that crashed into the limo-van that Morgan and his entourage were travelling in.

The lawsuit seeks punitive damages, claiming the retail giant was 'reckless' because it knew driver Kevin Roper had been awake for more than 24 hours at the time of the accident

He had been on the clock for 13-and-a-half hours, according to investigators. Rules permit truck drivers to work up to 14 hours a day, with a maximum of 11 hours behind the wheel.

Walmart said it was 'cooperating fully' in the ongoing investigation; while Roper is also facing a criminal prosecution. He has pleaded not guilty to charges relating to the crash.

The accident on the New Jersey Turnpike on June 7 also killed fellow comic James McNair, who used the stage name Jimmy Mack, and injured two others.
