Mark Thomas is to take Tony Blair to court should he declare war on Iraq.
The comic claims the Prime Minister could be in breach of international law by simply supporting any US-led attack.
"We're going to do our utmost to prosecute," he said.
Thomas has already held a benefit to raise the legal fees to take Britain to the international court in The Hague.
"We stand a good chance of getting this investigated," Thomas told Chortle. "It's fantastic we can do that.
"If we can force the Prime Minister of Britain into the dock for war crimes, I'd give three cheers for democracy - and it's been a long time since I've done that."
Thomas's action comes as he addresses the issue in his live tour A Minor Celebrity Discusses War Crimes (dates) and in a Channel 4 special: Mark Thomas... Weapons Inspector to be aired on Friday.
The show has just been edited, and Thomas said: "Some of it works very well, and other bits suffered because Channel 4 originally asked for 40 minutes, them made it 24 - so we've had to cram stuff down."
Stunts in the show include Thomas trying to gain entry to Buckingham Palace to look for weapons, and trying to board nuclear submarines at Faslane Naval Base in Rosyth - from a pedalo.
